Agreement to Terms. By booking a service, making a payment, or using any part of the website or communications of Nature Craft Tours (“we”, “us”, “our”), you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not proceed with a booking.

1. Definitions

  • Client/Guest/You: The person or entity making the booking, and all travelers covered by that booking.
  • Services: Tour packages, transport, accommodation, activities, permits, and related travel services arranged by us.
  • Voucher/Confirmation: Written confirmation of services issued after receipt of required payment(s).
  • Business Days: Monday to Saturday, excluding public holidays in West Bengal, India.

2. Eligibility & Documentation

  • It is your responsibility to carry valid government ID, passports, visas, travel insurance, health certificates, Inner Line Permits (if required), and any special permissions for restricted areas.
  • We can assist with guidance, but final responsibility for correctness and sufficiency of documents rests with you.
  • Minors must travel with a parent/guardian or with notarized consent as applicable by law.

3. Bookings, Payments & Invoices

  • Bookings are confirmed only after receipt of the stated advance and issuance of a written confirmation from us.
  • Balances are typically due 10–15 days before the start date unless stated otherwise on your invoice.
  • Failure to pay on time may result in cancellation as per the Cancellation Policy.
  • Payment modes accepted: bank transfer, UPI, approved cards, and other methods communicated by us.
  • All communications will be sent to the email/WhatsApp you provide; please ensure accuracy.

4. Pricing, Taxes & Currency

  • Prices are subject to change until the booking is confirmed. Confirmed prices may still change due to government tax changes, park fee revisions, fuel surcharges, or supplier changes beyond our control. We will inform you promptly of any material change.
  • Unless explicitly stated, prices are exclusive of GST and government levies. Applicable taxes will be added to the invoice.
  • If quoted in a foreign currency, settlement is based on the prevailing exchange rate at the time of final payment unless otherwise agreed in writing.

5. Inclusions & Exclusions

Each package’s inclusions/exclusions are specified in your quotation or itinerary. Unless listed as included, it is excluded. Common examples:

Typical Inclusions

  • Accommodation as per plan and room category
  • Meals as mentioned (e.g., MAP/CP/AP)
  • Transfers and sightseeing as per itinerary
  • Permits/park entry fees if specified
  • Guide/naturalist where specified

Typical Exclusions

  • Personal expenses (laundry, tips, beverages)
  • Optional activities and add-ons not listed
  • Medical costs and travel insurance
  • Flight/train tickets unless stated
  • Any item not expressly mentioned as included

6. Changes, Reschedules & Transfers

  • Client-initiated changes are subject to availability and any price/fee differences from suppliers.
  • Name/date transfers may be possible in limited cases; additional fees may apply.
  • If we must adjust an itinerary due to operational or safety reasons, we will offer a comparable alternative where feasible.

7. Cancellations & Refunds

To cancel, you must notify us in writing (email/WhatsApp). The effective date is when we acknowledge receipt during Business Days. Standard policy (unless your invoice states otherwise):

Note Certain peak dates, premium resorts, flights, trains, and national park permits may be 100% non-refundable from the time of booking as per supplier rules.

Approved refunds are processed to the original payment source within a reasonable time after we receive funds back from suppliers, less applicable fees and taxes.

8. Force Majeure

We are not responsible for failure or delay due to events beyond reasonable control, including but not limited to natural disasters, extreme weather, epidemics, government actions, strikes, route closures, or safety advisories. In such cases, we will endeavor to offer alternatives or credits where feasible, subject to supplier policies.

9. Health, Safety & Conduct

  • You are responsible for assessing your fitness for travel and obtaining medical advice, vaccinations, and medicines as recommended.
  • Follow safety instructions from guides, drivers, boatmen, and forest authorities at all times.
  • Alcohol or substance misuse, disruptive behavior, littering, wildlife disturbance, or disobeying lawful instructions can result in removal from the tour without refund.
  • Carry prescribed medications and disclose known severe allergies to your tour manager in advance.

10. Accommodation & Transport

  • Room categories, bed types, and views are as per availability at the time of check-in. Early check-in/late check-out is subject to the hotel’s policy and may incur charges.
  • Vehicles/boats are assigned based on group size, itinerary, and safety norms. Specific models are subject to operational availability.
  • Unforeseen delays due to traffic, tides, roadblocks, or mechanical issues may occur; reasonable alternatives will be arranged where possible.

11. Wildlife & Nature Activities

  • Wildlife sightings (e.g., tigers, dolphins, rare birds) can never be guaranteed.
  • National park operations (safari routes, watchtowers, closures) are controlled by government authorities and may change without prior notice.
  • Guests must adhere to park rules on noise, food waste, plastic, and safe distances from wildlife.

12. Third-Party Suppliers

We curate and coordinate services from independent suppliers (hotels, transporters, boat operators, airlines, etc.). Their terms also apply to your booking. We are not liable for acts/omissions of third parties beyond our control; however, we will reasonably assist in resolving issues.

13. Liability & Indemnity

  • To the maximum extent permitted by law, our aggregate liability is limited to the amount you paid to us for the specific service giving rise to the claim.
  • We are not liable for indirect, incidental, punitive, or consequential losses, including missed connections, loss of enjoyment, or profit.
  • You agree to indemnify us against claims arising from your breach of these Terms, unlawful acts, or negligence.

14. Privacy

We collect only necessary information to arrange services and communicate with you. We do not sell personal data. Limited data may be shared with suppliers strictly for operational purposes. For more details, request our Privacy Notice.

15. Intellectual Property

All content on our website and materials (text, photos, graphics, logos, itineraries) is protected. You may not copy, modify, or distribute it without prior written permission. Client-provided logos/names remain the property of their owners.

16. Governing Law & Disputes

These Terms are governed by the laws of India. Courts at Kolkata, West Bengal shall have exclusive jurisdiction. We encourage amicable resolution through good-faith discussion/mediation before litigation.

17. Miscellaneous

  • Severability: If any clause is unenforceable, the remainder stays effective.
  • Entire Agreement: These Terms, together with your confirmed itinerary/invoice, form the entire agreement.
  • Updates: We may update these Terms; the latest version will apply to future bookings.
  • Special Requests: Dietary, accessibility, or celebration requests are noted but not guaranteed unless confirmed in writing.
  • Insurance: We strongly recommend comprehensive travel insurance covering medical, cancellation, and baggage.

By clicking “I Agree”, paying an advance, or otherwise confirming your booking, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
